These terms outline the agreement between you and ScaleSmall.ai for the use of our AI marketing and business automation services.

Service Agreement

  • These terms govern your use of ScaleSmall.ai services including AI marketing and business automation, content creation, social media management, and business consulting
  • By using our services, you agree to these terms and our Privacy Policy
  • Our services let you connect third-party accounts and authorize Scale Small AI to create and publish content to those accounts on your behalf, as described in the "Social Media Account Connections" section below
  • Services are provided on a subscription basis with specific deliverables outlined in your service agreement
  • We reserve the right to modify or discontinue services with reasonable notice

Social Media Account Connections

  • Our services let you connect third-party accounts — including Facebook, Instagram, TikTok, X/Twitter, LinkedIn, Google Business Profile, and YouTube — and authorize Scale Small AI to create, schedule, and publish content to those accounts on your behalf through each platform’s official API
  • When you connect a TikTok account, you authorize us to publish videos to your TikTok profile or save them as drafts via the TikTok Content Posting API, and to read your basic profile information via TikTok Login Kit, as described in our Privacy Policy
  • You confirm that you own, or are authorized to manage and post to, every account you connect, and that content you ask us to publish does not infringe the rights of any third party
  • You can disconnect any connected account at any time from your dashboard or through the platform’s own app-permission settings; once disconnected, we stop posting to that account and delete the associated credentials as described in our Privacy Policy

Your Responsibilities

  • Provide accurate information about your business and marketing needs
  • Comply with all applicable laws and regulations in your use of our services
  • You are responsible for the content published to your connected accounts and for ensuring it complies with the terms, policies, and community guidelines of each platform, including the TikTok Community Guidelines and TikTok Terms of Service
  • Confirm you are authorized to manage and post to every social media account you connect
  • Respect intellectual property rights and not use our services for illegal activities
  • Maintain the confidentiality of any login credentials or access information provided

Service Limitations

  • AI-generated content may require review and editing before publication
  • Results may vary based on industry, competition, and market conditions
  • We cannot guarantee specific rankings, traffic increases, or business outcomes
  • Services are subject to third-party platform policies, and platforms may change, limit, or revoke API access at any time, which can affect publishing to connected accounts

Intellectual Property

  • Content is delivered to you as part of the service upon payment
  • Our proprietary AI systems, processes, and methodologies remain our intellectual property
  • You grant us permission to use your business information to provide services
  • We may use anonymized case studies and results for marketing purposes

Third-Party Platforms, Trademarks & No Affiliation

Our use of third-party platform APIs — including the TikTok APIs — is subject to, and conducted in compliance with, each platform's developer terms and policies, including the TikTok Developer Terms of Service and TikTok's Developer Policies.

You are responsible for ensuring that content published to your connected accounts complies with the terms, policies, and community guidelines of each platform, including the TikTok Community Guidelines.

Scale Small AI is an independent service. We are not endorsed by, sponsored by, certified by, or affiliated with TikTok, Meta (Facebook and Instagram), Google, X, LinkedIn, or any other platform. All product names, logos, and trademarks are the property of their respective owners and are used only to identify the platforms our service connects to.

Payment Terms

Billing

Services are billed monthly in advance. Payment is due within 30 days of invoice date.

Cancellation

You may cancel services with 30 days written notice. No refunds for partial months.

Late Payments

Late payments may result in service suspension and additional fees.

Limitation of Liability

ScaleSmall.ai provides services "as is" without warranties of any kind. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, data, or business opportunities
  • Third-party platform changes or restrictions
  • Results that may vary based on market conditions

Our total liability is limited to the amount paid for services in the preceding 12 months.

Termination

By You

You may terminate services at any time with 30 days written notice.

By Us

We may terminate services for breach of terms, non-payment, or other violations.

Effect of Termination

Upon termination, access to services will cease. Content previously delivered to you will remain accessible to you.

Governing Law

These terms are governed by the laws of Wyoming, United States. Any disputes will be resolved through binding arbitration in Wyoming.
